Lodging Of Prisoners

• 9.30 a.m. to 1.00 p.m. (Mulakat with their family members or friends on any two working days of a week as per convenience of the family members of the Prisoners except on Saturdays-Sundays & Gazetted Holidays)

• To provide for the safe and secure detention of the prisoners committed to Prison custody.
• To provide for the reformation and rehabilitation of prisoners.
• To provide for Basic Minimum facilities to prisoners to maintain human dignity.

• To provide minimum standard of living/treatment to the prisoners remanded to judicial custody and at the same time to reform /rehabilitate them by involving them in various vocational, spiritual, educational activities so that they become useful citizen of the country after their release.

• The Director General of Prisons, Delhi is the Head of the Prison Department and is assisted by Addl.I.G.(P) and Deputy Inspector General of Prisons. A Jail Superintendent heads each jails and Deputy Superintendents, Assistant Superintendents, Head Warders and Warders assist him.
• The custodial duties of the prisoners are performed by the Jail Staff where as the external security, Patrolling, search etc. are taken care by Tamil Nadu Special Police, ITBP and Central Reserve Police Force.
• A Battalion of Delhi Armed Police handles the escorting of the prisoners to the courts/hospitals etc.
• A Resident Medical Officer heads the Medical Administration of all Jails. Senior Medical Officers head the Medical administration of each jail assisted by Medical Officers and other para-medical staff.

Working hours for Mulakat with Prisoners

• 9.30 a.m. to 1.00 p.m. (Mulakat with their family members or friends on any two working days of a week as per convenience of the family members of the Prisoners)
• 3.30 PM to 5.30 PM (Mulakat with Advocate/counsels & Embassy officials).
• No public meeting on Saturdays, Sundays and Holidays

• Safe detention and release of prisoners;
• Wholesome and hygienic food to prisoners,
• Arranging interviews of prisoners with their relatives/friends;
• Visitor management system/tele-booking of interviews
• Education, spiritual, vocational and recreational activities for the prisoners in association with reputed NGOs;
• Specialty and super specialty medical care to prisoners lodged in jails,
• Creche facilities to the children staying with female prisoners,
• Free Legal Aid to Prisoners
• Holding of Special Courts for the confessing undertrials in petty offences
• Video Conferencing between courts and jails for extension of judicial remand.

• General Public can meet concerned jail Supdt., DIG(P) and DG(Prisons) in connection with any of their grievances on all working days
• DG (Prisons) petition box is circulated in all jails through the Petitions officer for speedy redressal.
• DIG(P) is the Vigilance officer – all complaints can be addressed to DG/DIG.
• Sampark Sabha by DG and Superintendents
• Panchayats of prisoners in each jail by Supdt Jail and Mahapanchayat with DG (Prisons).
• Visit of official and non-official visitors.
• Monthly visit by designated Addl. Sessions Judges who have their own petition boxes also.
• Fortnight visits by District Magistrates/Addl. District Magistrates.
• Grievance Redressal Committee U/S 57 of the Delhi Prisons Act, 2000 has been constituted in each jail – Appeal lies to DIG (P)
• Petitions to trial courts – prisoners can petition about their grievances.

• For Right to Information Act, 2005 each Jail Supdt. is Public Information Officer for the concerned Jail and Dy. Inspector General (prisons) is Public Information Officer for Prisons Head Quarters. The 1st Appellant Authority is the Director General (Prisons) for all Public Information Officer’s.
• All the Deputy Superintendents are Assistant PIO of their respective jails and Law officer is the Assistant PIO for Prison Headquarters.

• Maximum period for which an undertrial prisoner can be detained. Where a person has, during the period of investigation, inquiry or trial under this Code of an offence under any law (not being an offence for which the punishment of death has been specified as one of the punishments under that law) undergone detention for a period extending up to one-half of the maximum period of imprisonment specified for that offence under that law, he shall be released by the Court on his personal bond with or without sureties:
• Provided that the Court may, after hearing the Public Prosecutor and for reasons to be recorded by it in writing, order the continued detention of such person for a period longer than one-half of the said period or release him on bail instead of the personal bond with or without sureties: Provided further that no such person shall in any case be detained during the period of investigation inquiry or trial for more than the maximum period of imprisonment provided for the said offence under that law.
• Explanation.- In computing the period of detention under this section for granting bail the period of detention passed due to delay in proceeding caused by the accused shall be excluded.In writ petition Civil No.406 of 2013 vide its order dated 24.04.2015, Hon’ble Supreme Court has held as follows:
• In our opinion, while this may be the requirement of section 436A of code, it will be appropriate if in a case of multiple offences, a review is conducted after half the sentences of the lesser offence is completed by the undertrial prisoner. It is not necessary or compulsory that an UTP must retain in custody for at least half the period of his maximum sentence only because the trial has not been completed in time.

• There is under trial review committee in each District of Delhi which is headed by a District Judge.

• The Committee shall review the cases of under trial prisoners who have completed more than one-fourth of the maximum sentence.

The concerned Jail Superintendents shall prepare the list and send the same for review by the Committee every three month. The prepared list shall be uploaded by the concerned Jail Superintendent on the prison website.

• It is the duty of Jail Superintendent to educate the under trial prisoners about their right to get bail under the provision of 436A Cr.PC. and the panel of Delhi State Legal Services Authority shall also educate the inmates about release on bail and reduction of bail surety amount.
